청주지법 형사4단독 강현호 판사는 15일 성폭력범죄의 처벌 등에 관한 특례법 위반(공중 밀집 장소에서의 추행) 혐의로 불구속기소된 A(70대) 씨에게 징역 1년에 집행유예 2년을 선고했다.
법원은 A 씨에게 80시간 사회봉사와 40시간 성폭력 치료프로그램 이수를 명령했다. 3년간 아동·청소년·장애인 관련 기관 취업제한도 부과했다.
A 씨는 지난 7월 5일 시외버스에서 옆자리에 앉은 여성 B 씨의 무릎과 허벅지를 손바닥으로 만지고 끌어당겨 추행한 혐의로 재판에 넘겨졌다. A 씨는 지난 2월과 6월에도 시외버스에서 옆자리 여성을 상대로 같은 범행을 저질렀다.
A 씨는 과거 강제추행 혐의로 벌금형을 선고받은 전력이 있다.
A 씨 변호인은 법정에서 "피고인이 공소사실을 모두 인정하고 반성하고 있다"며 "금고형 이상의 형을 받을 경우 세무사업을 영위할 수 없게 된다는 점을 감안해 달라"고 선처를 호소했다.
강 판사는 "피고인은 불특정 다수인이 이용하는 버스 안에서 3명을 추행해 죄질이 좋지 않다"고 밝혔다. 이어 "피해자들과 합의한 점 등을 고려해 형을 정했다"고 판시했다.
A 씨는 이 판결에 불복해 항소했다.

Judge Kang Hyun-ho of the 4th Criminal Division of Cheongju District Court sentenced A, a man in his 70s, to 1 year in prison with 2 years of probation on December 15. A was indicted without detention on charges of violating the Act on Special Cases Concerning the Punishment of Sexual Crimes (molestation in crowded public places).
The court ordered A to complete 80 hours of community service and 40 hours of sexual violence treatment programs. The court also imposed a 3-year ban on employment at facilities related to children, youth, and people with disabilities.
A was indicted for groping a woman identified as B who was sitting next to him on an intercity bus on July 5. A touched and pulled B's knees and thighs with his palms. A committed the same offense against women sitting next to him on intercity buses in February and June.
A has a previous conviction for forcible molestation for which he received a fine.
A's defense attorney appealed for leniency in court, stating, "The defendant admits to all charges and is reflecting on his actions." The attorney added, "Please consider that he will be unable to continue his tax accounting business if sentenced to imprisonment or higher."
Judge Kang stated, "The defendant molested 3 people on buses used by the general public, and the nature of the crime is not good." The judge ruled, "The sentence was determined considering that the defendant reached settlements with the victims."
A appealed the verdict.
